These Terms and Conditions (“Terms”) govern your access to and use of the InstantDetect mobile application (the “App”) and related services provided by InstantDetect Solutions, Inc. (“Company,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
1. Eligibility. You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the App. By using the App, you represent and warrant that you meet this requirement.
2. Nature of Services. InstantDetect provides a mobile-based diagnostic support tool designed to assist in analyzing user-provided data, including images and related inputs.
Important:
- The App does not constitute a medical device unless explicitly designated and approved as such in a given jurisdiction.
- The App does not provide medical advice, diagnosis, or treatment.
- Results are informational only and must not be relied upon as a substitute for professional medical judgment.
- You agree to consult qualified healthcare professionals for medical decisions.
3. User Responsibilities. You agree to:
- Provide accurate and complete information
- Use the App only for lawful purposes
- Ensure proper use of the App in accordance with instructions
- Not misuse diagnostic outputs or represent them as definitive medical conclusions
- You are solely responsible for decisions made based on App outputs.
4. Account Registration (If Applicable). If account functionality is enabled:
- You are responsible for maintaining the confidentiality of login credentials
- You are responsible for all activity under your account
- You must notify us immediately of unauthorized use
5. Data Usage and Privacy. Your use of the App is also governed by our Privacy Policy. By using the App, you consent to:
- Collection and processing of data as described in the Privacy Policy
- Local and/or cloud-based data storage, depending on configuration
6. Offline Functionality. The App may function without internet connectivity. You acknowledge that:
- Data may remain stored locally on your device
- Synchronization or transmission occurs only when connectivity is enabled
7. Intellectual Property. All content, software, algorithms, and technology associated with the App are the exclusive property of InstantDetect Solutions, Inc. or its licensors.
You may not:
- Copy, modify, or distribute the App
- Reverse engineer or attempt to extract source code
- Use the App to develop competing products
8. Accuracy and Limitations. The Company does not guarantee:
- Diagnostic accuracy
- Continuous availability
- Error-free performance
- Outputs are based on algorithms and available data and may have inherent limitations.
9. Disclaimer of Warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
10. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, InstantDetect Solutions, Inc.SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- ANY LOSS RESULTING FROM RELIANCE ON APP OUTPUTS
- ANY MEDICAL OR HEALTH-RELATED OUTCOMES
- IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR USE OF THE APP.
11. Indemnification. You agree to indemnify and hold harmless InstantDetect Solutions, Inc. from any claims, damages, or expenses arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your reliance on diagnostic outputs
12. Regulatory and Compliance Notice. The App may be subject to regulatory requirements depending on jurisdiction. You agree:
- To use the App in compliance with applicable laws
- Not to use the App in regulated clinical environments unless expressly authorized
13. Modifications to the App and Terms. We reserve the right to:
- Modify or discontinue the App at any time
- Update these Terms
- Continued use after changes constitutes acceptance.
14. Termination. We may suspend or terminate your access:
- For violation of these Terms
- For misuse or unlawful activity
- At our discretion, with or without notice
15. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
16. Dispute Resolution. Any disputes arising under these Terms shall be resolved through:
- Good faith negotiations, followed by
